Terms of Use

1. Acceptance of These Terms

These Terms of Use (“Terms”) govern your access to and use of directom.com and any related pages, forms, newsletters, webinars and downloadable resources (together, the “Site”). The Site is operated by Direct Online Marketing, LLC (“DOM,” “we,” “us” or “our”).

By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.

These Terms cover use of the Site only. Marketing services DOM provides to clients are governed by the separate proposal, statement of work, or service agreement signed with each client. If those documents conflict with these Terms, the client agreement controls.

2. Use of the Site

The Site is intended for businesses and business professionals. You must be at least 18 years old, or the age of majority where you live, to use the Site or submit information through it. If you use the Site on behalf of an organization, you confirm you are authorized to accept these Terms for that organization.

You agree not to:

  • Use the Site for any unlawful, fraudulent or harmful purpose.
  • Submit false, misleading or someone else’s information through our forms.
  • Send spam, unsolicited promotions or automated submissions through our contact, audit or newsletter forms.
  • Attempt to gain unauthorized access to the Site, its servers or any connected systems.
  • Introduce viruses, malware or other harmful code.
  • Interfere with the Site’s operation, security or performance, including through excessive automated requests.
  • Copy, scrape or republish Site content except as permitted in Section 3.

We may suspend or block access to the Site for anyone who violates these Terms.

3. Intellectual Property

DOM or its licensors own all content on the Site, which is protected by copyright, trademark, and other laws. This includes blog posts, guides, checklists, webinars, glossary entries, case studies, graphics, logos, videos, and page design. “Direct Online Marketing,” “DOM,” and the DOM logo are trademarks of DOM. Third-party names and logos, including client and partner logos, belong to their owners.

Personal and internal business use. You may view, download, and print Site content for your own informational or internal business use. You may share links to Site pages and quote brief excerpts with clear attribution and a link to the original page.

Not permitted without our written permission:

  • Republishing, selling, or redistributing Site content, in whole or in substantial part.
  • Removing copyright or attribution notices.
  • Presenting DOM content as your own, or creating derivative works for commercial use.
  • Using DOM trademarks in a way that suggests endorsement or affiliation.

Automated access and AI systems. Search engines and AI systems may crawl and index the Site to surface it in search results and AI-generated answers, consistent with our robots.txt file and our AI instructions page. Accurate summaries that attribute DOM and link to the source are welcome. Bulk scraping or copying of Site content to build competing content, datasets, or products is prohibited except where the law allows it.

4. Informational Content and Results

General information only. Site content, including blog posts, guides, checklists, webinars, and free audit summaries, is provided for general informational purposes. It is not legal, financial, tax, or other professional advice, and it does not create a client relationship. Search engines, ad platforms, and AI tools change often, so some content may be out of date.

No guarantee of results. Case studies, client wins, statistics, and testimonials describe results achieved for specific clients under specific conditions. Results depend on many factors, including industry, budget, competition, platform changes, and the client’s own actions. Past results do not guarantee future performance, and no specific ranking, traffic, lead, or revenue outcome is promised.

Testimonials. Testimonials are from real clients who received no compensation for sharing their experience.

Free audits and consultations. A free strategic audit or consultation is offered with no obligation. Any recommendations in it are preliminary and based on the information available at the time.

5. Submissions, Third-Party Links and Privacy

Information you submit. When you complete a contact, audit, newsletter, webinar, or job application form, you confirm the information is accurate and that you have the right to share it. Our Privacy Policy explains how we collect, use and protect that information, including our use of cookies, analytics, advertising, and AI-powered business tools.

Feedback and ideas. If you send us suggestions or ideas about our Site or services, we may use them without obligation to you. Please do not send confidential information through Site forms; share it only under a signed agreement.

Emails. You can unsubscribe from marketing emails at any time using the link in each message.

Third-party links and tools. The Site links to third-party sites and platforms, such as Clutch, G2, Google, and social media networks, and may embed third-party tools. We do not control those services and are not responsible for their content, policies, or practices. Your use of them is governed by their own terms.

6. Disclaimers, Limitation of Liability and Indemnification

The Site is provided “as is.” We work hard to keep the Site accurate, secure, and available, but we can’t promise it always will be. The Site and its content are provided “as is” and “as available.” To the extent the law allows, we make no warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and any promise that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Limits on our liability. The Site is a free resource, so our responsibility for it is limited. To the extent the law allows, DOM and its owners, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages. We are also not liable for lost profits, revenue, data, or business opportunities that result from using or relying on the Site. If we are ever found liable for anything related to the Site, our total liability is limited to $50. Some places don’t allow these limits, so they may not all apply to you.

Indemnification. You agree to indemnify and hold harmless DOM and its owners, employees, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the Site.

7. Governing Law, Changes and Contact

Governing law and venue. These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law rules. Any dispute related to the Site will be brought in the Circuit Court of Ohio County, West Virginia, or the United States District Court for the Northern District of West Virginia at Wheeling, and you consent to their jurisdiction. This does not limit any mandatory consumer or data protection rights you have where you live.

Changes to these Terms. We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date above. By continuing to use the Site after changes are posted, you accept them.

General. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision does not waive it. These Terms and the Privacy Policy are the entire agreement between you and DOM about your use of the Site.
